482 visa cancellation for DASP (Departing Australia Superannuation Payment).  We have had a number of queries of late around 482 visa cancellation for DASP (Departing Australia Superannuation Payment).  DASP is applicable to temporary residents who live and work in Australia and wish  their superannuation to be refunded to them after departure from Australia.
 
We have reached out to Sam Morris , Director – Tax at SW in Australia to provide advice on this topic:
 
There are essentially 2 processes – firstly if you are applying for DASP within 6 months of leaving Australia and secondly if you are applying after 6 months.
 
If it is within 6 months and you no longer have an active visa then the application is to your super fund.
 
If it is after 6 months, the super will likely have been transferred to the ATO. The funds are still that of the individual, it’s just a different process. Once the funds go to the ATO there is no growth or earnings so that’s the downside but it can technically stay there for years before it is claimed. In fact, in future, if an individual then comes back on another visa the ATO can transfer to another super fund at that time.
 
The main issue with timing is around visa cancellation – in our experience if a visa has less than 6 months to run before expiry then it is unlikely the Department will cancel. From a practical perspective it simply means a DASP application to the ATO rather than the super fund.
